Les présentes conditions générales ont pour objet de définir les modalités et conditions d’utilisation du service de mise en relation (ci-après : le « service ») des personnes souhaitant bénéficier des moyens de transport pour une destination donnée (ci-après : les « clients ») avec un chauffeur de taxi, un chauffeur partenaire indépendant, ou une société de location de voitures (ci-après : le « chauffeur ») à travers l’application YASSIR (ci-après : « l’application »), dans les pays éligibles à savoir l’Algérie, la Tunisie et le Maroc, le Canada et la France  (ci-après : « Pays éligibles ») ainsi que de définir les droits et obligations des parties dans ce cadre.

Elles sont notamment accessibles à tout moment par un lien direct sur l’application et / ou le site web.

Elles peuvent être complétées, le cas échéant, par des conditions d’utilisation particulières. En cas de contradiction, les conditions particulières prévalent sur ces conditions générales.

YASSIR vous fournit un service d’intermédiaire entre le chauffeur partenaire YASSIR et vous , et n’acquiert pas à ce titre la qualité ou la nature d’un prestataire de services de transport.

  • Qui propose le service de mise en relation YASSIR

Le service de mise en relation à travers la plateforme Yassir et Yassir Chauffeur est proposé par les pays éligibles suivants  :

  • Définitions

« Application/Applications » désigne les applications YASSIR et YASSIR Chauffeur développées par la société YASSIR, disponible sur APP STORE en ce qui concerne les smartphones sous  IOS, et  Google Play en ce qui concerne les Smartphones sous Android. 

 « Codes Promos » désigne les codes promotionnels qui donnent lieu à une ou plusieurs réduction(s) au bénéfice du Compte ou autres avantages liés aux Service et/ou Services sous réserve de toutes les conditions complémentaires que YASSIR définit pour chaque code promotionnel ;

« Compte » désigne le compte qui doit être créé pour pouvoir accéder aux services proposés par la Plateforme, 

« Conditions » désigne les présentes conditions générales d’utilisation ;

« Client»  désigne toute personne physique ou morale souhaitant bénéficier des moyens de transport pour une destination à travers l’application YASSIR client ou YASSIR BUISINESS ;

«Chauffeur partenaire YASSIR » désigne un conducteur individuel, un prestataire tiers indépendant (qui fournit des taxis, des véhicules de location privés, des véhicules de covoiturage et autres) qui a conclu un contrat avec la société YASSIR pour exploiter le véhicule, dans chacun des pays éligibles cités à l’article 02 des présentes ; 

« Contenu de l’Utilisateur » désigne les contenus et informations textuels, audio et/ou visuels,  communiqués lors de votre inscriptions, y compris les commentaires et les retours d’information relatifs aux Services ou aux Services de Tiers, ainsi que les contenus et informations communiqués lors de demandes d’assistance et à l’occasion de la participation à des jeux-concours et à des opérations promotionnelles ;

« Frais Additionnels » désigne les frais exigibles, le cas échéant, en complément des tarifs applicables aux Services en cas notamment de non-respect de vos obligations à l’égard des chauffeurs partenaires YASSIR, tels que décrites dans les présentes. Les frais Additionnels sont ajoutés aux tarifs applicables, le cas échéant ;

« Services » désigne les services disponibles sur les applications et / ou site web YASSIR ;

« Site Web » Interface dynamique disponible sur l’adress www.yassir.io  ;

« Tarifs » désigne les prix applicables aux Services qui vous seront expressément communiqués via l’Application et/ou Site Internet au moment de la validation de la commande correspondante ; 

«E-paiement ou Moyen de paiement électronique  »

désigne tout instrument de paiement, autorisé conformément à la législation en vigueur, permettant à son titulaire d’effectuer des paiements de proximité ou à distance à travers un système électronique.

  • Accès à l’application et au service

Le service est accessible, sous réserve des restrictions prévues sur l’application Yassir :

  • À toute personne physique disposant de la pleine capacité juridique conformément à la loi en vigueur 

dans les pays éligibles pour s’engager au titre des présentes conditions générales.

  • À toute personne morale agissant par l’intermédiaire d’une personne physique disposant de la capacité 

juridique pour contracter au nom et pour le compte de la personne morale.

  • Acceptation des conditions générales

L’acceptation des présentes conditions générales est matérialisée par une case à cocher dans le formulaire d’inscription de l’application Yassir et / ou site web. Cette acceptation ne peut être que pleine et entière. Toute adhésion sous réserve est considérée comme nulle et non avenue.

En acceptant les présentes Conditions Générales, l’utilisateur prend acte que les applications YASSIR et YASSIR CHAUFFEUR sont utilisées que dans le cadre de demande en ligne de chauffeur partenaire pour le  transporter d’un point A à un point B. 

L’utilisateur qui utilise les applications  YASSIR  et YASSIR CHAUFFEUR pour un autre motif que celui de demander des chauffeurs en ligne, causant un préjudice à la société YASSIR, fera l’objet d’une plainte auprès du tribunal territorialement compétent.

  • Inscription sur le site web et / ou l’application

L’accès au service nécessite que vous vous inscriviez sur l’application Yassir, en remplissant le formulaire prévu à cet effet. vous êtes  tenus de fournir l’ensemble des informations marquées comme obligatoires (Nom, prénom, adresse et surtout le numéro de téléphone)toute inscription incomplète ne sera pas validée.

Avant la création de votre profil , YASSIR doit vérifier votre numéro de téléphone en l’envoyant à l’un de ses fournisseurs.

Après que le numéro de téléphone soit  vérifié, votre profil  est automatiquement créé (Ci-après : le « Profil »), en vous donnant accès à un espace personnel (ci-après : l’espace personnel ») qui vous permet de gérer votre  utilisation du service, sous une forme et selon les moyens techniques que la société juge les plus appropriés pour rendre le dit Service.

  • Description du Service

Le Service consiste à vous mettre en relation directe avec un chauffeur partenaire YASSIR de la société à travers l’application et / ou  site web Yassir, et ce, dans tous les pays éligibles cités à l’article 2 des présentes.

L’accès au service nécessite obligatoirement que vous ayez un Smartphone et /ou un dispositif avec accès internet (Connexion 3G et/ou 4G);

Le service Yassir repose sur un principe de géolocalisation, si vous  souhaitez effectuer un trajet, vous devez simplement vous  connecter sur l’application. Une fois fait, vous devez juste introduire votre  destination ; le prix de la course s’affiche sur votre écran, vous pourrez ensuite valider la demande en appuyant sur le bouton: “demander un Yassir”. 

La demande est envoyée instantanément au chauffeur partenaire YASSIR le plus proche de votre  position, une fois acceptée par ce dernier, le trajet peut commencer. 

7.1. Prix du Service

Les prix du service sont fixés au préalable par la société et sont indiqués explicitement sur l’application YASSIR et YASSIR CHAUFFEUR, sauf mention contraire, ils sont exprimés selon la devise de chacun des pays éligibles cités dans l’article 02 des présentes, et en toutes taxes comprises.

La société se réserve le droit, à sa libre discrétion et selon des modalités dont elle sera seule juge, de proposer des offres promotionnelles ou des réductions de prix. 

  • Pour le Maroc :

Les prix sont affichés  sur l’application. Ils sont conformes aux règlements édictés par les Wilayas de chacune des villes où Yassir opère. S’ajoutent aux prix édictés par les Wilaya, les frais de services de l’application qui se présentent comme suit :

Prix de base 

Prix de base édicté par la Wilaya + 6,00 MAD 

Prix par minute 

Prix par minute édicté par la Wilaya + 0,50 MAD

Prix minimum

Prix minimum édicté par la Wilaya + 7,50 MAD

La société se réserve le droit de proposer des offres promotionnelles ou des réductions de prix touchant uniquement ses frais de service.

7.2. Révision des Prix

Le prix du service peut faire l’objet d’une révision par la société à tout moment, et à sa libre discrétion. Vous serez informé de ces modifications par tous moyens de communication (mail, appel, sms, site web), sous un préavis de 24H au moins avant l’entrée en vigueur des nouveaux tarifs.

Si vous  n’acceptez pas les nouveaux prix, vous devez mettre fin à votre utilisation du service selon les modalités prévues à l’article 16 des présentes conditions générales. À défaut, il sera réputé avoir accepté les nouveaux tarifs. 

  • Pour le Maroc :

Les prix peuvent être révisés sous réserve des dispositions de l’article 7.1 ci-dessus .

7.3. Modalités de paiement : 

L’utilisation de l’application YASSIR ne donne lieu à aucune tarification, autrement dit le téléchargement de l’application et l’inscription sont totalement gratuits.

Selon chacun des  pays éligibles cités dans l’article 02 des présentes, le client pourra payer ses prestations  selon les modalités suivantes : 

Paiement en argent comptant : Et ce, après chaque course effectuée et une fois arrivé à destination, vous payez directement le chauffeur partenaire le montant indiqué sur l’application en argent comptant. 

Paiement en ligne  : l’utilisateur a la possibilité de choisir un moyen de paiement en ligne parmi ceux proposés par la société YASSIR pour régler sa commande au niveau de la page de paiement. 

Dans ce cas, la remise de la transaction pour débit du compte de l’utilisateur est effectuée suivant les délais de chaque pays éligibles cité dans l’article 2 des présentes 

 

Les paiements Multicanaux de l’utilisateur sont sécurisés par le Centre Monétique Interbancaire de chaque pays éligible, qui offre un service de paiement entièrement sécurisé.

 

Le Consommateur garantit la Société YASSIR qu’il dispose des autorisations éventuellement nécessaires pour utiliser le mode de paiement choisi par lui. 

7.4. Facturation

Le service fait l’objet de factures qui vous seront communiquées par mail dans un délai de 24 h suivant la fin d’une course, vous pouvez être facturé soit pour les courses immédiates, les réservations à l’avance ou les frais d’annulation.  

Les factures que vous recevrez détaillerons le prix et les caractéristiques de la course, notamment les gratifications accordées par vous aux partenaires YASSIR.    

  • Contestation des factures

Toute facture ne faisant l’objet d’aucune contestation écrite par vous dans un délai de 30 jours à compter de sa date d’envoi sera réputée acceptée par ce dernier.

  • Retard de paiement

En cas de retard de paiement, quelle qu’en soit la cause, YASSIR  vous facturera à titre de frais de rappel, ainsi que des frais de recouvrement en sus.

  • Données

Vous  reconnaissez et acceptez expressément :

  • que les données recueillies sur l’application Yassir chauffeur et / ou site web et sur les équipements informatiques de YASSIR font foi de la réalité des opérations intervenues dans le cadre des présentes ;
  • que ces données constituent le seul mode de preuve admis entre les parties, notamment pour le calcul des sommes dues à YASSIR.

Vous pourrez accéder à vos  données dans votre Espace Personnel.

  • Obligations des parties :

9.1. Obligations de la société

Offrir le téléchargement gratuit de l’application Yassir ;

– Fournir une page de présentation sur l’application Yassir sur la base des informations fournies.

– Mettre à votre disposition dans l’Application Yassir un service de gestion de votre compte, notamment l’historique de vos courses effectuées ;

– Offrir un service d’évaluation et de notation afin d’améliorer la qualité du service.

9.2. Obligations du client : 

Sans préjudice des autres obligations prévues aux présentes, vous vous engagez à :

– Ne pas annuler la course une fois que le chauffeur partenaire arrive au point rendez-vous. En cas d’annulation, vous êtes tenu de payer les frais d’annulation (comme indiqué au point 11.4)  pour indemniser le chauffeur partenaire ; 

  • Ne causer de gênes, ennuis, nuisances ou dommages matériels, que ce soit leur nature à l’égard du chauffeur partenaire ou à toute autre partie ;
  • Veiller à garder le véhicule propre ; 
  • Verser au chauffeur partenaire la totalité de la somme affichée au préalable sur l’application YASSIR ;
  • Bien veiller sur ses objets, en cas de perte, la société ne sera être tenue responsable ; 
  • Respecter les lois et règlements en vigueur et ne pas porter atteinte aux droits de tiers ou à l’ordre public ; 
  • Mettre à jour ses informations dans son espace personnel en cas de modifications, afin qu’elles correspondent toujours aux critères susvisés (Nom, prénom, Numéro de téléphone, …… etc.) ; 
  • Utiliser personnellement le service et ne permettre à aucun tiers de l’utiliser à sa place ou pour son compte, sauf à en supporter l’entière responsabilité ; 
  • Prendre toutes les précautions nécessaires pour se prémunir contre les actes de piraterie, notamment en configurant vos systèmes informatiques de manière appropriée et sûre, et en installant régulièrement un logiciel antivirus à jour ; 
  • Fournir à la société toutes les informations nécessaires à la bonne exécution du service.
  • Responsabilité des parties

10.1. Responsabilité de la société

– La société s’engage à fournir le service avec diligence et selon les règles de l’art, elle ne peut en aucun cas être responsable des relations entre les Clients et les Chauffeurs partenaire YASSIR  n’intervient aucunement dans les trajets, leur qualité, leur sécurité, leur localisation, leur paiement ou leurs horaires, car ayant la qualité d’intermédiaire, la société se voit engagée à une obligation de moyens à l’exclusion de toute obligation de résultat, ce que les clients comprennent, reconnaissent et acceptent expressément ; 

– La société s’engage à procéder régulièrement à des contrôles afin de vérifier le fonctionnement et l’accessibilité de l’application. À ce titre, elle se réserve la faculté d’interrompre momentanément l’accès à l’application pour des raisons de maintenance. De même, elle ne saurait être tenue responsable des difficultés ou impossibilités momentanées d’accès à l’application qui auraient pour origine des circonstances qui lui sont extérieures, la force majeure, ou encore qui seraient dues à des perturbations des réseaux de télécommunication ;

– La société ne peut être tenue responsable des contenus, dont les auteurs sont des tiers, toute réclamation éventuelle devant être dirigée en premier lieu vers l’auteur des contenus en question. Les contenus préjudiciables à un tiers peuvent faire l’objet d’une notification à la société, qui se réserve de prendre les mesures décrites à l’article 12 ;

– La société décline toute responsabilité en cas de perte éventuelle des informations accessibles dans votre espace personnel, lorsque cette perte a été causée par votre fait ;

– La société décline toute responsabilité en cas de perte d’objet et / ou effet qui vous appartient, au moment de la course ; 

– La société se désengage de toute responsabilité en cas d’utilisation du service non conforme aux présentes conditions par vous, elle décline toute responsabilité en cas d’un éventuel préjudice qui pourrait résulter de l’indisponibilité des applications Yassir et Yassir Chauffeur ou d’un problème de connexion.

10.2. Responsabilité du client

– Garantit que toutes les informations qu’il communique dans le formulaire d’inscription sont exactes, à jour et sincères et ne sont entachées d’aucun caractère trompeur ;

Vous êtes informé et vous acceptez que les informations saisies aux fins de création ou de mise à jour de votre profil vaillent preuve de son identité ;

– Vous êtes informé et  vous acceptez que la mise en œuvre du service nécessite qu’il soit connecté à internet et que la qualité du Service, dépend directement de cette connexion, dont il est seul responsable ;

– Vous êtes seul responsable des contenus de toute nature (rédactionnels, graphiques, audiovisuels ou autres, y compris la dénomination et/ou l’image éventuellement choisies pour l’identifier sur l’application) qu’il diffuse dans le cadre du service (ci-après désignés : les « Contenus ») ;

– Vous garantissez à la société que vous disposez de tous les droits et autorisations nécessaires à la diffusion de ces contenus ;

– Vous  vous engagez à ce que lesdits contenus soient licites, ne portent pas atteinte à l’ordre public, aux bonnes mœurs ou aux droits des tiers.

  • Conditions particulières : 

11.1. En cas de retard :

Conformément aux règles d’usage, vous êtes  informé qu’en cas de retard ou d’incident subi, vous vous engagez à contacter le chauffeur partenaire YASSIR par téléphone pour l’avertir, vous vous  engagez également à informer la société dans les plus brefs délais possibles.

vous recevrez une notification pour signaler l’arrivée du chauffeur partenaire YASSIR au lieu de prise en charge, le début de la période d’attente sera facturée après l’arrivée du chauffeur. Ces frais permettent d’indemniser les efforts et le temps d’attente du chauffeur partenaire  YASSIR . Ceux-ci continuent à s’appliquer jusqu’à ce que votre chauffeur partenaire YASSIR démarre la course, ces frais seront facturés sur les prochaines courses. 

En cas de non-présentation, le Chauffeur partenaire YASSIR  est libre de partir et d’annuler la course après un délai de 10 minutes à compter de l’envoi de la notification. 

La fonctionnalité ‘temps d’attente facturé” est disponible sur tous les types de véhicule de YASSIR; 

Si votre course est annulée et que les frais d’annulation vous sont portés en compte, le temps d’attente ne vous sera pas facturé.

11.2 En cas d’incident au cours de la prestation :

– En cas d’incident (accident de la circulation, vol, agression du client, etc.) au cours de la prestation,vous êtes  invité (dans la mesure du possible) à avertir la société et à lui transmettre toute information utile, via tous les supports de communication cités à l’article 02 des présentes. La société prendra toutes mesures utiles le cas échéant. 

– La société ne peut être tenue responsable de quelque manière que ce soit en cas de désaccord ou litige, entre vous et les Chauffeurs partenaires YASSIR sur les effets et/ou objets perdus, et/ou oubliés par vous. 

11.3 En cas d’annulation de la demande de course par le chauffeur partenaire YASSIR :

En acceptant les présentes conditions générales, vous reconnaissez avoir pris connaissance :

  • qu’un délai d’attente minimum de 20 secondes est nécessaire pour qu’un chauffeur partenaire accepte sa course ;
  • qu’une fois votre demande acceptée par le chauffeur partenaire YASSIR, ce dernier s’engage dans les plus brefs délais en respectant autant que possible la durée d’arrivée au point de rencontre avec vous; 
  • que le chauffeur partenaire YASSIR  est en droit d’annuler la course lorsqu’il est dans un cas de force majeure ou pour un motif extérieur à sa volonté, si ce dernier ne l’a pas encore commencé, dans cette hypothèse, vous serez  prévenu soit par le chauffeur partenaire YASSIR soit par la société, et  vous serez invité de refaire une autre demande. 

11.4 En cas d’annulation de la réservation immédiate  par le client: 

-L’annulation est gratuite dans les 10 secondes suivant votre  demande, et avant que le chauffeur partenaire se présente au point de rendez-vous. Passé le délai, les frais d’annulation seront facturés dans votre prochaine course, les frais visent à indemniser les chauffeurs partenaire YASSIR pour une course annulée après qu’ils se soient rendus au point de rendez-vous.

11.5 Annuler la réservation: 

– La réservation d’un chauffeur partenaire YASSIR  peut être annulé à n’importe quel moment jusqu’à avant l’heure prévue de votre prise en charge sans avoir à payer de frais d’annulation (même si un chauffeur partenaire  YASSIR a déjà été affecté)  

Pour les annulations de dernière minute, ou dans les cas où le chauffeur partenaire est déjà arrivé au lieu de rendez-vous indiqué par le client , les frais d’annulation seront aussi facturés;  

– Les frais d’attente et d’annulation sont inclu sur la catégorie VTC et cela  varie en fonction du temps ( jour /Nuit)  et la zone géographique  ainsi que le montant de la course;

  • Comportements prohibés

En acceptant les présentes conditions générales d’utilisation de l’application Yassir, vous reconnaissez  avoir pris connaissance Qu’il est strictement interdit de : 

– Utiliser l’application YASSIR à des fin autres que ceux prévu dans les présentes conditions générales ; 

– Porter atteinte à l’ordre public ou de violer  les lois et les règlements en vigueur 

– De fumer dans le véhicule ; 

– De manger dans le véhicule ;

  D’injurier le chauffeur partenaire ;

– De commettre des actes de violence ;

– De harceler  sexuellement le chauffeur partenaire YASSIR ;

– De contacter les chauffeurs partenaires YASSIR hors l’application Yassir ;

– De manquer de respect envers le chauffeur partenaire YASSIR ;

– De lancer des demandes fictives, frauduleuses ou trompeuses ;

Si vous ne respectez pas ces consignes,vous pouvez être suspendu d’accéder à l’utilisation du service selon les modalités prévues à l’article 12.

  • Sanctions des Manquements 

En cas de manquement à l’une des dispositions des présentes conditions générales ou plus généralement, d’infraction aux lois et règlements en vigueur par vous, la société se réserve le droit de prendre toute mesure appropriée et notamment de :

  • Suspendre l’accès au service sans préavis, de l’auteur du manquement ; 
  • Supprimer tout contenu mis en ligne sur l’application ;
  • Avertir toute autorité concernée ;
  • Engager toute action judiciaire, sans préjudice des dommages et intérêts auxquels YASSIR pourra prétendre devant le tribunal territorialement compétent pour le préjudice subi.
  • Propriété intellectuelle

Les systèmes, logiciels, structures, infrastructures, bases de données et contenus de toute nature (textes, images, visuels, musiques, logos, marques, base de données, etc …) exploités par YASSIR au sein de l’application Yassir et / ou site web sont protégés par tous droits de propriété intellectuelle ou droits des producteurs de bases de données en vigueur. Tous désassemblages, décompilations, décryptages, extractions, réutilisations, copies et plus généralement, tous actes de reproduction, représentation, diffusion et utilisation de l’un de ces éléments, en tout ou en partie, sans l’autorisation de YASSIR sont strictement interdits et pourront faire l’objet de poursuites judiciaires.

  • Données à caractère personnel

YASSIR pratique une politique de protection des données personnelles dont les caractéristiques sont explicitées dans le document intitulé « Charte de confidentialité », dont vous êtes expressément invité à prendre connaissance sur l’application et / ou le site web.

  • Liens et sites tiers

YASSIR ne pourra en aucun cas être tenue pour responsable de la disponibilité technique de sites internet ou d’applications mobiles exploités par des tiers (y compris ses éventuels partenaires) auxquels vous accéderez par l’intermédiaire du site.

YASSIR n’endosse aucune responsabilité au titre des contenus, publicités, produits et/ou services disponibles sur de tels sites et applications mobiles tiers dont il est rappelé qu’ils sont régis par leurs propres conditions d’utilisation.

YASSIR n’est pas non plus responsable des transactions intervenues entre vous  et un quelconque annonceur, professionnel ou commerçant (y compris ses éventuels partenaires) vers lequel vous serez orienté par l’intermédiaire du site et ne saurait en aucun cas faire partie de litiges éventuels avec ces tiers concernant notamment la livraison de produits et/ou services, les garanties, déclarations et autres obligations quelconques auxquelles ces tiers sont tenus.

  • Durée des Services, désinscription

Les Services sont souscrits pour une durée indéterminée.

Vous pouvez vous désinscrire des Services à tout moment, en adressant une demande à cet effet à YASSIR par email, aux coordonnées mentionnées à l’article 2.

La désinscription est effective immédiatement. Elle entraîne la suppression automatique de votre Compte.

  • Modifications

YASSIR se réserve la faculté de modifier à tout moment les présentes conditions générales.

Vous  serez informé de ces modifications par tout moyen utile.

Si vous n’acceptez pas les conditions générales modifiées, vous devez vous désinscrire des Services selon les modalités prévues à l’article 16.

Si vous avez eu recours aux Services postérieurement à l’entrée en vigueur des conditions générales modifiées, vous êtes réputé avoir accepté ces modifications.

  • Loi applicable et juridiction

Les présentes conditions générales sont régies par les lois de chaque pays éligible cité dans l’article 2  des présentes conditions générales.

CONDITION PARTICULIÈRE YASSIR

  • Types de véhicule ( Car types ) : 

Type de véhicule (Cartypes) est un nouveau service accessible sur L’application YASSIR , une fois que le client saisit sa destination , une liste d’option apparaîtra en bas de l’écran, Il suffit de choisir le type de véhicule qui vous convient, chaque service  varient en terme de prix selon la taille et le confort. 

Certains types de véhicules  sont permanents, d’autres ne sont disponibles que pour une période promotionnelle, et certains qui ne sont pas disponibles sur votre région.

  • Transport sanitaire médicalisé terrestre et aériens:

En partenariat avec la société Medevac Assistance international, qui est une société de service spécialisée dans le domaine de l’assistance médicale et technique, notamment le transport des clients par ambulance terrestre ou aérien et  qui détient toutes les autorisations et agréments en vue de cette activité , YASSIR lance Le service de mise en relation de transport sanitaire terrestre et aérien, YASSIR assure le transport non urgent et planifié des clients  dont l’état de santé les empêche de se rendre dans un centre de traitement par tout autre moyen, ou qui ont besoin des compétences d’un assistant de soins ambulanciers pendant le voyage, au moyen de sa plateforme de mise en relation qui les mettra directe en contact avec Medevac, grâce à la nouvelle option Type de véhicule (Car Types). 

Les équipes sont formées et sélectionnés par Notre Partenaire MEDEVAC  en tant qu assistants de soins ambulanciers et possèdent des connaissances spécialisées en matière de premiers secours, de conduite et de techniques de déplacement et de manipulation des client.

Service fournis: 

Selon l’urgence de la situation, l’état de santé du  client  et l’itinéraire, YASSIR en partenariat avec MEDEVAC  peut proposer différents moyens de transport :

  • Transport Sanitaire Médicalisé terrestre :
  • Transport sanitaire médicalisé aériens :

Réservation du transport sanitaire Terrestre et/ ou Aériens  : 

Afin que sa réservation soit prise en compte, le client  doit fournir toutes les informations nécessaires à la demande, à savoir notamment le type de transport, la raison de transport, le nombre de personnes à transporter, les dates et lieux de départ et d’arrivée;

  • La réservation ne peut pas être effectué avant 2 heurs; 
  • Le tarif est susceptible d’être modifié du tarif afficher au moment de votre demande et cela jusqu’à la confirmation de la demande; 
  • Les prix sont calculer selon le type de transport fournis et selon le kilométrage et l’heure; 

Annuler la reservation :

La réservation ne peut être annulée après la confirmation de la demande, des frais d’annulation peuvent s’appliquer et facturés;

  • Livraison des colis : 

Les présentes conditions générales particulières ont pour objet de définir les modalité d’utilisation de service de transport et distributions  de(s) courrier(s) et / ou colis proposés par YASSIR; grâce à la nouvelle option Type de véhicule; 

  • Le prix  et délai de la livraison : 

Le prix de la livraison est calculé  en fonction de la zone de destination, dimension et poids du colis ; 

Le délai de livraison est également indiqué en fonction de la destination choisie;

Le règlement s’effectue au moment du dépôt du colis;

  • Engagement du client : 
  • le client  s’engage expressément à fournir des informations exactes, complètes et à jour le concernant et concernant sa commande (coordonnées de l’expéditeur, du, détails du Colis, etc.).
  • Le client  garantit que le contenu de son Colis est licite. 
  • Le client s’engage  à Choisir un emballage adapté, pour qu’il assure une protection suffisante; 
  • Le client s’engage à donner une description complète et détaillés du contenue des colis;
  • Toute livraison doit être accompagnée par un bordereau d’envoi; 
  • livraison prohibés :

– tous produits dangereux, munitions, gaz, les matières inflammables, radioactives, toxiques, infectieuses ou corrosives, ainsi que tous les objets qui, par leur nature ou leur conditionnement, peuvent présenter un danger pour le livreur, l’expéditeur ou endommager les autres colis transportés, les véhicules ou les tiers ; 

– les bijoux, articles d’horlogerie, les pierres et métaux précieux, les monnaies,  chèques , devises, billets de banque, valeurs financières ou mobilières, 

– les animaux, 

– les armes à feu, les armes de guerre ou de collection chargées ou non, les stupéfiants, les psychotropes, les œuvres d’art, les objets d’art, les antiquités, les publications ou supports audiovisuels interdits par toute loi ou réglementation applicable ;

– les réponses à appels d’offres, 

-des documents qui contiennent  des informations sensibles ou caractère personnel; 

  • LIMITATION DE RESPONSABILITE : 

Le client  est responsable des mentions portées sur le bordereau de livraison , notamment de celles relatives au nom, à l’adresse du destinataire et au numéro de téléphone et/ou l’adresse courriel,  des mentions obligatoires qui doivent être précises, exactes et complètes pour permettre une distribution dans des conditions normales.

YASSIR  se dégage de toute responsabilité dans le cas de dommage ou pertes de contenu; 

YASSIR se dégage de toute responsabilité dans le cas de perte de dommage matériel causé au colis en cours de transport ou de non-livraison  ou en cas de force majors 

 YASSIR  ne sera  pas responsables en cas d’une adress incorrecte 

  • En cas d’annulation:

Le client peut annuler avant le pick up dans un délai d’une heure;

Le client ne peut pas annuler après le pick up , des frais d’annulation peuvent être facturés;

  1. Purpose and contracting relationship 

The purpose of these general terms and conditions is to define the terms and conditions of use of the services offered on the site and/or application (hereinafter: the “Services”), as well as the rights and obligations of the parties in this context.

Access to and use of the Services are subject to the present Conditions, which the E-consumer must read and accept before accessing and using the Services. Acceptance of the present Conditions establishes a contracting relationship between the E-consumer and YASSIR. These Terms expressly supersede any previous contracts or agreements between the E-consumer and YASSIR.

YASSIR may modify the present Conditions at any time. The modified Conditions shall be communicated by any means made available. 

By accessing or using the Services, the E-Consumer agrees to be bound by the Terms as modified at the time he uses the Services. The E-Consumer acknowledges that he/she remains free at any time to use or not to use the Services. 

YASSIR EXPRESS proposes a service by which E-consumers will be put in relation with E-suppliers for the purchase of consumable food products (hot and cold meals, foodstuffs, basic necessities…) and/or remote service presented on the application and/or website, and benefit from the delivery to the destination of their choice; 

YASSIR EXPRESS also offers its own stores where the E-consumer can do his shopping, through the YASSIR MARKET and YASSIR KITCHEN sections available on the YASSIR EXPRESS application and/or website. 

In this context, it is recalled that YASSIR EXPRESS acts as an intermediary, its role being limited to putting the E-consumer in direct contact with the E-supplier. Except in the case of its own stores through the two headings YASSIR MARKET and YASSIR KITCHEN 

The present general conditions are accessible and printable at any time by a direct link at the bottom of the home page of the site and/or in the YASSIR EXPRESS application. 

They may be supplemented, if necessary, by conditions of use particular to certain services, such as for example the conditions governing a particular event or a particular activity or promotion, and the said additional conditions shall be communicated in the Application and/or the Website, in the context of the Services concerned. Such additional terms shall be in addition to these Terms and shall be deemed to be part of the Terms for the purposes of the relevant Services, once accepted by the E-consumer. In case of contradiction, the special conditions shall prevail over these general conditions.

  1. Who offers the YASSIR EXPRESS linking service

  1. Definitions

“Application/Applications/Website” shall mean the application and/or websites of YASSIR EXPRESS developed by YASSIR, available on App Store for IOS users, Google Play for ANDROID users and App Gallery for Huawei users;

“Account” shall mean the account that must be created in order to access the services offered by the application and/or website;

“Terms” shall mean these general terms of use. 

“E-Consumer” shall mean any natural or legal person who acquires, against payment or free of charge, a good or a service by means of the Application and/or website of YASSIR EXPRESS from an E-supplier for an end use.

“E-Supplier” shall mean any natural or legal person who markets or offers the supply of goods or services by way of electronic communications.

“Intervener within YASSIR Express platform” shall mean any intervener within the framework of distribution circuit of goods and services via digital platforms in accordance with Article 10 of the 2019 Finance Law.

“E-payment or electronic means of payment” means any payment instrument, authorized in accordance with the legislation in force, enabling its holder to make proximity or remote payments through an electronic system.

“User Content” shall mean the textual, audio and/or visual content and information communicated during your registration, including comments and feedback relating to the Services or Third-Party Services, as well as content and information communicated during requests for assistance and in connection with participation in contests and promotional operations;

“E-shop” shall mean the dedicated space within YASSIR EXPRESS made available to the E-supplier to offer consumable food products (hot and cold meals, foodstuffs, basic necessities, etc.) and/or services;

“Services of the E-suppliers” designates the services and the food or grocery and retail goods provided by E-suppliers; these services are made available to E-consumers available on YASSIR EXPRESS applications and/or website;

“Internet Site” shall mean the dynamic interface accessible at the addresses: https://express.yassir.io/ any other Internet site operated by YASSIR and provided in the framework of the Services;

“Tariffs” shall mean the prices applicable to the Services which will be expressly notified to you via the Application and/or Internet Site at the time of validation of the corresponding order. 

  1. Access to the Application and the Service:

The service is accessible, subject to the restrictions provided for on the YASSIR EXPRESS application:

To any natural person having full legal capacity in accordance with the law in force in the eligible countries to commit under these general conditions.

To any legal entity acting through a natural person who has the legal ability to contract in the name and on behalf of the legal entity.

  1. Acceptance of the general conditions

The acceptance of the present general conditions is materially indicated by a box to be ticked in the registration form of YASSIR EXPRESS application and / or website. This acceptance can only be full and complete. Any conditional acceptance is considered null and void.

The E-consumers take note that the use of the YASSIR EXPRESS application and/or website shall only be for the purpose of the service mentioned in the object.  

The use of the application and/or website for any other reason than that mentioned in the object is strictly forbidden and may expose its author to legal proceedings, notwithstanding the damages and interest for the caused harm.

  1. Subscription on the website and / or application:

Access to the service requires the E-consumer to register on the YASSIR EXPRESS application, by filling in the form provided for this purpose.  The E-consumer must provide all the information marked as compulsory (Name, first name, E-mail and especially his telephone number) Any incomplete registration will not be accepted.

The E-consumer acknowledges that for the creation of his profile, YASSIR will have to provide his telephone number to one of its suppliers for authentication. 

After checking the phone number, the E-consumer’s profile is automatically created, (hereinafter: the “profile”), allowing him/her to access a personal account (hereinafter: the “personal account”) which enables him/her to manage his/her use of the Service, according to the form and the technical means that the company deems most appropriate to render the said Service.

  1. Description of the Service:

The Service consists of connecting the E-consumer directly with an E-supplier through the application and/or website of YASSIR EXPRESS in all eligible countries mentioned in Article 2 hereof.

Access to the service requires that the E-consumer has a Smartphone and/or a device with internet access (3G and/or 4G connection).

Each item selected by a simple click is followed by a description, a photo and a list of compatible accessories, for which the E-supplier is solely responsible.

With a simple click on the link or on the Order button, the item of your choice is placed in the shopping cart, which contains the products/meals/services that the E-consumer plans to purchase and/or benefit from.

It is possible at any time to access the basket (by clicking on the button representing a basket) and to modify its contents by adding or deleting an item.

  1. Prices of the Services

The prices of the Service are indicated on the YASSIR EXPRESS application, unless otherwise stated, and are expressed in the currency of the eligible countries mentioned in Article 2 hereof. 

The prices displayed are in accordance with the regulations of each eligible country.

YASSIR reserves the right, at its own discretion and according to the terms and conditions to be determined by YASSIR, to propose promotional offers or price reductions.  

8.1 Price Review

The price of the Service may be revised by YASSIR at any time and at its own discretion without having to inform the E-consumer and/or notify him of such changes.

If the E-consumer does not accept the new prices, he should terminate his use of the Service in accordance with the terms and conditions set forth in Article 23 of these General Conditions. Otherwise, he will be deemed to have accepted the new prices. 

8.2 Terms of payment

The use of YASSIR EXPRESS application does not give rise to any pricing, i.e. the downloading of the application and the registration are totally free.

According to each of the eligible countries mentioned in article 02 of the present document, the E-consumer may pay for his services according to the following methods: 

Payment in cash: After each order has been placed and delivered, the E-consumer may pay the participant directly to the YASSIR EXPRESS platform in the amount indicated on the application in cash. 

Online payment: The E-consumer has the possibility to choose a means of online payment among those proposed by the company YASSIR to settle his order at the level of the payment page. 

In this case, the submission of the transaction for debiting the account of the E-consumer is carried out according to the deadlines of each eligible country mentioned in article 2 hereof 

The E-consumer’s multi-channel payments are secured by the Interbank Electronic Money Center of each eligible country, which offers a fully secure payment service.

The E-consumer guarantees YASSIR that he has the necessary authorizations to use the payment method chosen by him.

8.3 Invoicing

The service is subject to invoices which are communicated to the E-consumer by any useful means.

8.4 Late payments and payment incidents

The E-consumer is hereby informed and expressly accepts that any delay in payment of all or part of an amount payable on its due date shall automatically, notwithstanding the provisions of Article 19 and without prior notice, result in the forfeiture of all sums due by the E-consumer and their immediate payment;

In addition to the expiration of the term, the E-consumer may be exposed to additional charges; immediate interruption of the current service until full payment of all sums due by the E-consumer;

  1. Conformity of the products: 

YASSIR EXPRESS makes its best efforts to ensure that the photographic representation of the products is as faithful as possible to the real products; however, it is possible that the E-consumer’s perception of the photographic representation of the products does not correspond exactly to the actual product.

In the case of non-conformity of consumable food products (hot and cold meals, foodstuffs, basic necessities, etc.), the E-Consumer may return them at the time of delivery; furthermore, based on the principle that they are consumable food products, especially with regard to meals, the return is not accepted.

In case of return at the time of delivery, the E-consumer is given the possibility that YASSIR:

– Re-deliver to him a product in conformity with his order;

– Refund the order within the order according to the deadlines of each eligible     country, from the date of the product’s reception.

Refund Policy in South Africa: 

Refund requests need to be processed within 24 hours of the order being placed. Refunds will only be issued under the following circumstances:

  • If we cancel an order after having charged your card, the full value of the order will be refunded including any applicable fees, or
  • If an item is damaged, expired, or missing, the value of the defected item will be refunded.

An approved refund request will be processed to your Yassir Wallet or the card linked to the original transaction within 3-5 business days. The approval of refund requests remains at the sole discretion of Yassir.

  1. Order: 

Each item chosen through a simple click, is followed by a descriptive sheet, a photo and a compatible accessory list, for which the E-supplier is solely responsible.

With a simple click on the link or on the Order button, the item of your choice is placed in your shopping cart, which contains the products/meals/services that the E-consumer plans to purchase and/or enjoy.

It is possible at any time to access the basket (by clicking on the button representing a basket) and to modify its contents by adding or deleting an item.

10.1 Validation of the order by the E-consumer

In order to complete his order, the E-consumer shall check his basket and click on the Order button, a confirmation message shall then appear, with the general terms and conditions and privacy charter of YASSIR EXPRESS application, the E-consumer shall then press the Confirm my order button, accepting the general terms and conditions of use of the YASSIR EXPRESS application and the privacy charter. 

Any unconfirmed order cannot be processed.

10-2 Availability:

The availability of the consumable food products (hot and cold meals, foodstuffs, basic necessities, etc.) and/or services is displayed on the site/application, on each consumable food product (hot and cold meals, foodstuffs, basic necessities, etc.) and/or service sheet. If one of the consumable food products (hot or cold meals, foodstuffs, basic necessities…) and/or service is unavailable, the mention “Unavailable” will be displayed on the page. 

If subsequently, the order becomes unavailable, YASSIR EXPRESS shall inform the E-consumer by email or by any other means of communication mentioned in Article 2 hereof of such unavailability and shall give the E-consumer the possibility to choose either:

To make a pre-order of consumable food products (hot, cold meals, foodstuffs, products of first need) and/or service, as soon as the latter are available the order is then considered confirmed; or

To cancel the order.  

10-3 Pre-order: 

The Pre-order is the opportunity to reserve consumable food products (hot, cold meals, foodstuffs, necessities…) and/or service as soon as it is released and as soon as it is in stock/available.

The order will be delivered to the E-consumer when the last consumable food product (hot, cold meals, foodstuffs, necessities…) and/or service on pre-order is in stock or available.

10-4 Order cancellation: 

The E-consumer may cancel the order provided that: 

– That this cancellation is done in the case where the E-supplier has not accepted the order.

– If Yassir Express platform’s participant delivers the order to its destination, the E-consumer must pay the service and delivery charges previously displayed on YASSIR EXPRESS application even in case of cancellation of this order.

  1. Delivery

The consumable food products (hot and cold meals, foodstuffs, basic necessities, etc.) and/or services shall be delivered to the delivery address chosen by the E-consumer as indicated at the time of ordering. The E-consumer undertakes to receive the consumable food products (hot or cold meals, foodstuffs, basic necessities, etc.) and/or services ordered. The receipt of the order is followed by an acknowledgement of receipt by the E-consumer, with a copy sent subsequently. 

YASSIR is responsible for the order of the E-consumer from the moment the

the person working with the Yassir Express platform picks it up from the E-supplier and delivers it to the destination indicated on the YASSIR EXPRESS application when ordering, beyond this period of time and once the delivery has been confirmed, the E-consumer understands that YASSIR is not responsible for what may happen to the delivered food products (hot or cold meals, foodstuffs, basic necessities, etc.) and/or service. 

11.1 Delivery time

The date and type of delivery are chosen by the E-consumer according to the delivery times available on the website and/or application. The date is deemed, unless otherwise proven, to be an agreement between the Parties.

YASSIR EXPRESS and its E-CONSUMERS shall then make their best efforts to respect the delivery deadlines of the orders. 

In case these deadlines cannot be met, the E-consumer shall be automatically informed by any means, in particular by e-mail, SMS or phone.

11.2 Delivery charges: 

Delivery charges may vary depending on the amount of the basket, the delivery location, the frequency of the E-consumer’s purchase between two orders and the chosen day and time. Delivery charges are calculated automatically and indicated at the time of choosing the delivery day and time slot. This means that the E-consumer can find out the amount of the delivery costs by clicking on the “Shopping Cart” icon on the “delivery and service charges” line.

  1. Defect of a product

Any product whose delivery has been confirmed by the E-consumer at the time of its reception by an intervener at the Yassir Express platform which appears after this delivery to contain a hidden defect making it unfit for its intended use, the E-consumer shall refer this to the E-supplier as soon as possible by any means of communication made available to him by YASSIR EXPRESS.  

In this case, the delivery costs shall be borne by the E-supplier. 

  1. Complaints

The E-consumer shall have the right to contact YASSIR at any time for any information related to its services and products, or for any claim related to the latter, using the contact details mentioned in article 2 of the present general conditions.

  1. Data

The E-consumer acknowledges and expressly agrees:

That the data collected on the YASSIR EXPRESS application and/or website and on the computer equipment of YASSIR are proof of the reality of the operations carried out within the framework of the hereby agreement;

That these data constitute the only admissible means of proof between the parties, in particular for the calculation of the sums owed to YASSIR. The E-consumer may access these data in his personal account.

  1. Obligation of the parties

15.1 YASSIR’s Obligation(s)

Offer the E-consumer a free download of YASSIR EXPRESS application;

Provide the E-consumer with a presentation page on YASSIR EXPRESS application based on the information he has provided; 

Place at the disposal of the E-consumer in YASSIR EXPRESS Application with a service of management of his account, in particular the history of his completed orders;

Supply the order within the time limits;

Offer the E-consumer an evaluation and rating service in order to improve the quality of the service.

Follow up by phone to ensure the delivery of the order.

Process order returns for products that have not arrived on time. 

Process returns of orders for products that do not conform to the request made by the E-consumer.

15.2 E-Consumer’s Obligation(s)

Notwithstanding the other obligations set forth herein, the E-consumer agrees to:

Respect the laws and regulations in force and not to infringe the rights of third parties or public order;

Update his information in his personal account in case of modifications, so that they always match the above-mentioned criteria (name, surname, telephone number, etc.);

Use the service personally and do not allow any third party to use it in his place or on his behalf; 

Be careful and discerning in its relations and communications;

Respect the usual rules of politeness and courtesy in his exchanges with other users;

Ensure that his order is correct, in case of erroneous order, the company will not be held responsible; 

Pay to the intervener at Yassir Express platform the totality of the sum indicated beforehand on YASSIR application;

Provide the company with all necessary information for the proper execution of the service, actively cooperating with the company for the good performance of this agreement.

  1. Liability of Parties

16.1 YASSIR’ liability

YASSIR undertakes to provide the service with diligence and according to good practice. 

The company shall not be liable for any failure, error or delay in the performance of its services or during the delivery of goods, when such failure occurs as a result of any act or omission, which is beyond its reasonable control, such as all extreme and unavoidable events caused directly and exclusive by the exercise of prudence and diligence;

The company cannot be liable in any way for the relationship between E-consumers and the intervener in Yassir Express platform nor for those between the E-consumer and the E-supplier;

YASSIR can in no case be involved in the quality of the orders, being specified their location, their payment or their schedules, as having the quality of intermediary, the company is committed to an obligation of means excluding any obligation of result, which the users understand, recognize and accept expressly; 

YASSIR undertakes to proceed to regular controls in order to check the functioning and the accessibility of the application. In this respect, it reserves the right to interrupt momentarily the access to the application for maintenance reasons; 

Moreover, YASSIR cannot be held responsible for difficulties or momentary impossibilities of access to the application which would have for origin circumstances which are external, the case of force majeure, or which would be due to disturbances of the telecommunication networks;

YASSIR cannot be held responsible for the contents whose authors are third parties, any possible complaint towards the author of the contents in question, the harmful contents to a third party can be the object of a notification to the company which reserves to take the measures detailed in the article 12 of the current conditions; 

YASSIR declines all responsibility for any loss of the information accessible in the personal account of the customer if such loss has been caused by the E-consumer;

YASSIR disclaims any liability in case of use of the service by the E-consumer that does not comply with the present conditions; YASSIR disclaims any liability in case of a possible prejudice that could result from the unavailability of Yassir EXPRESS applications or from a connection problem.   

16.2 E-consumer’s liability

The E-consumer guarantees that all the information he/she provides in the registration form is accurate, up-to-date and sincere and is not misleading;

The E-consumer is hereby informed and agrees that the information entered for the purpose of creating or updating his/her profile shall constitute proof of his/her identity; 

The E-consumer is informed and accepts that the implementation of the service requires that he/she be connected to the Internet and that the quality of the service depends directly on this connection, for which he/she is solely responsible; 

The E-consumer is also solely responsible for the relationships he/she may establish with other users and the information he/she communicates to them within the framework of the said service;

The E-consumer is solely responsible for the content of any kind (editorial, graphic, audiovisual or other, including the name and/or image that may be chosen to identify him/her on the application) that he/she distributes within the framework of the service (hereinafter referred to as the “Content”); 

The E-consumer guarantees the company that he/she has all the necessary rights and authorizations to broadcast this content;

The E-consumer undertakes to ensure that the said content is lawful and does not infringe public order, good morals or the rights of third parties.

  1. Special Conditions

17.1 In case of late delivery

In accordance with the rules of use, the E-consumer is informed that in case of delay or incident incurred during the delivery of the order, the company undertakes to contact the E-consumer by phone to notify him of the delay, the E-consumer will have the opportunity to grant us another deadline in order to respond or refuse his request. 

17.2 In case of unavailability of the order or inability to deliver

By accepting these terms and conditions, the E-consumer acknowledges that:

If the product is not available from the E-supplier but the latter has other similar products, YASSIR may call the E-consumer to inform him of other options. If the E-consumer does not accept any of the options offered by the E-supplier and is therefore not interested in the alternative options, YASSIR shall not confirm the E-consumer’s order so that the latter will not be sent to the operators on YASSIR EXPRESS platform. 

 

17.3 Products prohibited from sale by the regulations in force

The E-consumer hereby acknowledges having been informed that the products prohibited for sale by the regulations in force in each of the eligible countries mentioned in Article 02 above shall not be offered to him/her by Yassir Express application.

  1. Prohibited behaviors

By accepting the present general conditions of use of YASSIR EXPRESS application, the E-consumer acknowledges that it is strictly forbidden to: 

  • Violate public order or the laws and regulations; 
  • Use YASSIR EXPRESS application for purposes that do not comply with the present general conditions of use; 
  • Disrespect the intervener on Yassir Express platform, insult him, sexually harass him or commit acts of violence against him:
  • Making fictitious, fraudulent or misleading requests;
  • Getting involved in disputes with Yassir Express interveners; 
  • Contact the interveners of YASSIR Express platform beyond Yassir EXPRESS application;

The E-consumer, who fails to comply with these instructions, will be subject to sanctions, depending on the seriousness, ranging from a simple verbal warning, to the definitive deletion of his account.

  1. Penalties for Violations 

In case of breach of any of the present terms and conditions or, more generally, breach of the laws and regulations in force by the E-consumer, the company reserves the right to take any appropriate action, including

– Suspend access to the service for the author of the breach without prior notice; 

– Delete any content posted on the application;

– Notify any relevant authority;

– Initiate any legal action, notwithstanding the damages to which YASSIR may claim before the competent court for the incurred damage.

  1. Intellectual property

The systems, software, structures, infrastructures, databases and contents of any nature (texts, images, visuals, music, logos, trademarks, databases, etc.) operated by YASSIR within YASSIR EXPRESS application and/or website are protected by all intellectual property rights or rights of the producers of databases in force. All disassemblies, decompilations, decryptions, extractions, reuses, copies and more generally, all reproduction, representation, diffusion and use of one of these elements, in whole or in part, without the authorization of YASSIR are strictly forbidden and may be subject to legal proceedings.

  1. Personal data

YASSIR practices a policy of personal data protection, the characteristics whereof are explained in the document entitled “Confidentiality Policy”, that the E-consumer is expressly invited to take note of on YASSIR EXPRESS application and/or the website.

  1. Links and third-party sites

YASSIR shall in no case be held responsible for the technical availability of Internet sites or mobile applications operated by third parties (including its possible partners) accessed by the E-consumer through the site.

YASSIR does not assume any responsibility for the contents, advertisements, products and/or services available on such third-party websites and mobile applications, which are governed by their own terms of use.

YASSIR is not responsible either for the transactions between the E-consumer and any advertiser, professional or trader (including its possible partners) that the E-consumer would be directed towards via the site and shall not be party to any possible disputes with these third parties concerning in particular the delivery of products and/or services, the guarantees, declarations and other obligations of any kind that such third parties are bound to.

  1. Duration of the Services, unsubscription

The Services are subscribed to for an indefinite period.

The E-consumer may terminate the present general terms and conditions at any time, by sending a request to this effect to YASSIR by email, to the contact details mentioned in article 2.

The unsubscription is effective immediately. It leads to the automatic deletion of the user’s account.

  1. Modifications

YASSIR reserves the right to modify at any time the present general conditions.

The E-consumer shall be informed of these modifications by any appropriate means.

The E-consumer who does not accept the modified general terms and conditions must unsubscribe from the Services in accordance with the terms and conditions set forth in Article 16.

Any E-consumer who uses the Services after the entry into force of the modified general terms and conditions is deemed to have accepted these modifications.

  1. Applicable law and jurisdiction

These terms and conditions are governed by the laws of each of the countries eligible for these terms and conditions.

In case of dispute regarding the validity, interpretation and/or performance of these terms and conditions, the parties of each eligible country listed in Article 02 of these terms and conditions agree to submit the dispute to the competent court.

  1. Entry into force

The present general conditions will come into force as soon as the E-consumer accepts them by pressing the “accept” button.

PARTICULAR CONDITIONS

  1. Purpose

The purpose of the present special conditions is to define the terms and conditions of use of the services offered on YASSIR EXPRESS site/application (hereinafter: the “Services”), as well as the rights and obligations of the parties thereto.

YASSIR EXPRESS proposes a new service enabling E-consumers to be connected with E-suppliers for laundry and dry-cleaning services, dry cleaning or pressing, textile maintenance for professional dry and/or wet cleaning of textiles (clothing / household linen, etc.) available on YASSIR EXPRESS application/website. This service also offers collection and home delivery. 

The user of YASSIR EXPRESS application may at any time access this document and/or print it out or read it on his account (hereinafter: “account”).

The present special conditions are accessible and printable at any time by a direct link at the bottom of the home page of the site. 

  1. Definitions 

The terms and expressions below shall be interpreted according to the definition provided in this article: 

“Service” shall mean the dry cleaning, laundry and dry-cleaning services, dyeing, textile care available on YASSIR EXPRESS application/site;

“Application(s)” refers generically to YASSIR EXPRESS applications downloadable and running from smartphone or tablet operating systems, published by YASSIR, available on the Apple Store, Google Play and/or any other download platform chosen by YASSIR;

“Site” shall mean the dynamic interface accessible at www.yassirexpress.io or any other website operated by YASSIR and made available in connection with the Services.

“Laundry” shall mean any activity that consists in ensuring the cleaning of clothes and linen with water and detergent and other operations such as stain removal, degreasing, ironing…; 

“Dyeing or dry cleaning” shall mean any activity that consists of providing dry cleaning of textiles that are delicately treated and other operations such as stain removal, degreasing, ironing and dyeing of clothes and linens;

“Dry Cleaning” shall mean the cleaning process that uses a solvent other than water to wash clothes and linens; 

“Special General Conditions” shall mean the present special conditions applicable to all Users of the Site/Application of YASSIR EXPRESS; 

“E-consumers” shall mean any natural or legal person who acquires, against payment or free of charge, a good or a service by means of YASSIR EXPRESS Applications from an E-supplier for an end use;

“E-supplier” shall mean any natural or legal person who markets or offers the supply of goods or services by way of electronic communications; 

“Pressing” shall mean dry or wet cleaning of textiles provided by the E-consumer, which consists of sorting, staining, washing, ironing and folding of textiles as determined by the E-supplier, delivered to the E-consumer in a protective cover;

“Article” shall refer to any product given by the E-consumer to get one or more Services. The Articles can only be textile products, legal and without danger to health. The Articles are deemed to be the property of the E-consumer;

“Delivery” shall mean the collection and delivery of the clothes/linen from the address communicated by the E-consumer through YASSIR EXPRESS application/site, to the laundry, and from the laundry to the address communicated by the E-consumer.

  1. Delivery of the deposit ticket

Upon each request made by the E-consumer through YASSIR EXPRESS application and / or website, a delivery man will come to the place of the request, in order to take the articles from the E-consumer against a deposit ticket duly signed by the latter. 

The deposit ticket shall contain the following information

– The name or brand name and address of the store; 

– The date of delivery of the given item; 

– The nature and the number of the delivered articles; 

– The quality of the provided service and the service charge.

  1. Obligations

E-consumer’s Obligations

Fill in the deposit ticket with the number and condition of the items delivered by the delivery man;

Ensure and check the condition of the items before giving them to the delivery man;

Undertake to remove all objects and foreign elements from the items (especially metal, plastic, cosmetics, paper); 

Have the care label on each article given to the delivery man;

Pay the price of the service once the article is processed by the E-supplier;

Claim a copy of the deposit ticket;

Respect the deadlines of the articles collection;

Respect the laws and regulations in force;

Update his information in his personal account in case of modifications, so that they always match the above-mentioned criteria (Name, first name, phone number, etc.);

Use the service personally and not to allow any third party to use it in his place or on his behalf; 

Give the articles in a clean laundry bag.

YASSIR’s Obligations

Provide the linking service in the best conditions; 

Ensure the collection and the delivery of the articles given by the E-consumer;

Respect the deadlines of the delivery as well as the deadlines of the recovery of the articles; 

Use the necessary equipment for the delivery of the items.

  1. Responsibility

5.1 E-consumer’s Responsibility

The E-consumer guarantees that all information provided in the registration form is accurate, up-to-date and sincere and is not misleading;

The E-consumer agrees that he/she shall check his/her request before validation (the desired service, the number of items to be processed, the price…) so that he/she does not encounter any misunderstanding, cancellation and/or return; 

The E-consumer is responsible for the strict compliance of the deposited items to those described on the deposit ticket any difference between an item mentioned on the deposit ticket and the item handled by the E-supplier will result in the correction of the service and, if necessary, the adjustment of price.

The E-consumer is also solely responsible for any material hidden in the laundry bag given to the delivery man at the time of collection of the items; 

In case of non-compliance with his commitment to remove objects and foreign materials as stated in article 4 above, the E-consumer shall be liable for any damage caused by these objects.

5.2 YASSIR’s Responsibility:

YASSIR undertakes to provide the service diligently and in accordance with the best practices. 

YASSIR provides a service of connecting the E-consumer and the E-supplier through YASSIR MARKET application and/or website, and can in no way be held liable for any problems that may arise at the level of the dry cleaner, being reminded that it is bound by an obligation of means in accordance with the laws and regulations in force; 

YASSIR cannot be held liable in case of loss of an article not ticked on the deposit ticket by the E-consumer; 

YASSIR cannot be held liable in case of loss of an article, and/or delay in delivery during a period of force majeure;

The liability of YASSIR is engaged and limited between the moment of collection of the articles by the delivery man and their deposit at the E-supplier for treatment, and the moment of recovery of the treated articles from the E-supplier and their deposit at the E-consumer. 

  1. Delivery:

The delivery of the articles shall be made to the delivery address chosen by the E-consumer as indicated at the time of his order on the application and/or website of YASSIR EXPRESS.

The receipt of the articles by the E-consumer after processing shall be made against an acknowledgement of receipt on the checklist.

Delay of delivery:

In accordance with the applicable rules, the E-consumer is informed that in case of delay or incident incurred during the delivery of the order, YASSIR undertakes to contact him by phone and / or by any means, in order to notify him of the caused delay, and to ask for another delay which is appropriate for delivery.

  1. Checking the general condition of the items: 

The E-consumer is aware that when the items are sent to the E-supplier for processing, the latter must examine them and make written reservations on the “deposit ticket”, if he considers that stains will not be removed, that a lining will not stand up well to cleaning or that buttons may be damaged… He can possibly refuse the service, in this case, the E-supplier must return the article in its initial state. 

In any case, the E-supplier must deliver the articles to the E-consumer after treatment

The E-supplier shall make every effort to provide a service in good conditions. 

The E-supplier is responsible for the condition in which it returns the item after processing.

  1. Terms of payment: 

Payment in cash: After each order placed and once delivered, the E-consumer can pay the delivery man directly the amount indicated on the application in cash. 

Payment by credit card or bank card: Using a bank card or credit card. The accepted bank cards are the cards opened in the banking institutions or of payment of one of the eligible countries, the E-consumer informs the references of the bank card (No of the card, the expiration date, cryptogram) the payment will be carried out with the delivery. 

NB: The placing of this order implies full and complete adherence to the General Conditions of Use indicated on YASSIR EXPRESS application at the time of downloading. 

  1. Return and compensation:

The E-supplier is considered responsible towards the E-consumer for the state in which he returns the article he has been assigned, in particular for the deteriorations undergone during the treatment; 

The E-supplier can only be held liable in case of fault, deduced in this case by comparison between the condition of the articles at the time of delivery and at the time of return.

  1. In case of loss of articles

The E-supplier is subject to a return obligation under the partnership agreement.

In case of impossibility to return the items entrusted to the E-Consumer (loss, theft, fire), the responsible party is required to compensate the amount of the items, which is calculated on the basis of the E-Supplier’s scale, unless he can prove that he was not at fault and that the loss was due to an unforeseeable external cause.

  1. Entry into force

These special conditions shall come into force as soon as the E-Consumer presses the “accepted” button.

Delivery Person:

1- Purpose

The purpose of the present general terms and conditions is to define the terms and conditions of use of the service of putting in contact (hereinafter: the “Service”) persons wishing to order remotely consumable food products (hot and cold meals, groceries, basic necessities, etc.) (hereinafter: the “E-consumer”) directly from an E-Supplier (hereinafter: the “E-Supplier”) through the Yassir Express platform (hereinafter: the “E-Supplier”): (hereinafter: the “E-Supplier”) directly from an E-Supplier (hereinafter: the “E-Supplier”) with the help of a participant in the Yassir Express platform (hereinafter: the “intervener with the Yassir Express platform”) through the YASSIR EXPRESS DELIVERY application (hereinafter: the “application”), in the eligible countries, namely Algeria, Tunisia,Morocco, Senegal and South Africa (hereinafter: the “eligible countries”), as well as defining the rights and obligations of the parties in this context.

They are accessible at any time by a direct link on the application and / or website.

They can be completed, if necessary, by particular conditions of use. In the event of contradiction, the special conditions shall prevail over these general conditions.

The term “intervener with the Yassir Express platform” is understood in the sense of these general conditions: 

With regard to Algeria “a intervenant within the framework of distribution circuit of goods and services via digital platforms in accordance with Article 10 of the Finance Act of 2019”   

With regard to Morocco and Tunisia and South Africa, “any person owning a two-wheeled vehicle and providing a delivery service of food products or any other type of products at home to the E-consumers of the Yassir EXPRESS application”

3- Access to the application and the service

The service is accessible, subject to the restrictions provided for in the Yassir EXPRESS application:

– To any natural person having full legal capacity in accordance with the law in force in the eligible countries to commit under these general conditions; 

– Any legal entity acting through a natural person who has the legal capacity to contract in the name and on behalf of the legal entity.

4- Acceptance of the general conditions

The acceptance of the present general conditions is materialized by a box to be ticked in the registration form of the Yassir EXPRESS DELIVERY application and / or website. This acceptance can only be full and complete. Any conditional acceptance is considered null and void.

By accepting the present General Conditions, the Users acknowledge that the use of the YASSIR EXPRESS application shall only be for the service provided for this purpose.

The use of the application for a reason other than that which was envisaged exposes the latter to penalties, without prejudice to the legal actions that YASSIR may institute.

5- Registration on the site and/or the application

Access to the service requires that the participant in the YASSIR EXPRESS platform register on the application, by filling in the form provided for this purpose. The participant in the YASSIR EXPRESS platform must provide all the information marked as obligatory (Name, first name, type of two-wheeled vehicle, address and especially his telephone number). Any incomplete registration will not be validated.

In order for the registration to be validated, the participant to the YASSIR EXPRESS platform must provide a valid telephone number as well as the necessary documents, according to each eligible country.

The participant in the YASSIR EXPRESS platform acknowledges that for the creation of his profile, YASSIR will have to communicate his telephone number to one of its suppliers for authentication. 

After the verification of the telephone number, the profile of the Deliverer is automatically created (hereinafter: the “Profile”), giving him access to a personal account (hereinafter: “the personal account”) which allows him to manage his use of the Service, according to the form and the technical means that the company deems most appropriate to render the said Service.

6- Description of the Service

The Service consists of putting the E-consumer in direct contact with a delivery person on the company’s YASSIR EXPRESS platform through the Yassir EXPRESS DELIVERY application, in all the eligible countries mentioned in Article 2 hereof.

Access to the service requires that the delivery person has a Smartphone and/or a device with internet access.

The Yassir service is based on the principle of geolocation, any actor on the YASSIR EXPRESS platform wishing to make a delivery must simply connect to the application, once this is done, he will just have to wait for a request to be sent to him by the E-consumers closest to his position, the actor on the YASSIR EXPRESS platform will then be able to validate one of these requests by pressing the validation button.

6.1-Order: 

An order is understood to be any request (for consumable food products (hot or cold meals, foodstuffs, basic necessities, etc.) that can be delivered in an isothermal container by the parties involved to the YASSIR EXPRESS platform or by any other means formulated by the E-consumer via the YASSIR EXPRESS platform for contact; 

6.2- Acceptance of the order: 

Once the E-consumer has placed his order and the designated E-supplier has accepted it, an automatic notification is sent directly to the nearest YASSIR EXPRESS platform, which he shall in turn accept. The company will proceed to a telephone follow-up, in order to ensure the routing of the order. 

6.3- Receipt of the order at the E-provider: 

Once the order has been accepted by the intervening party at the YASSIR EXPRESS platform, the latter shall without delay go to the E-provider in order to take it.  Before receiving this order, the intervening party at the YASSIR EXPRESS platform shall : 

– verify that the content corresponds to the request of the E-consumer; 

– ensure that it is well packed and preserved; 

– load it into the isothermal container if the order is a cold and/or hot meal, in order to carry it out; 

6.4- Delivery of the order to the E-consumer:

 Once the order has been loaded into the isothermal container, the intervening party at the YASSIR EXPRESS platform shall proceed immediately without loss of time to its delivery to the address of the E-consumer while respecting the aforementioned delivery deadlines. 

6.5- Service prices

The prices of the Service are indicated on the Yassir EXPRESS DELIVERY application, unless otherwise stated, and are expressed in the currency of the eligible countries.

The prices displayed are in accordance with the regulations of each eligible country.

The company reserves the right, at its own discretion and in accordance with the terms and conditions of which it shall be the sole judge, to propose promotional offers or price reductions. Its promotional offers or price reductions may in no case affect the participant with the YASSIR EXPRESS platform, as long as it is the company that deducts them from its commission.

6.6- Invoicing

The service shall be the subject of invoices which shall be communicated to the intervener on the YASSIR EXPRESS platform by any useful means. 

6.7- Delays and incidents of payment

The intervening party to the YASSIR EXPRESS platform is informed and expressly accepts that any delay in payment of all or part of a sum due on its due date shall automatically entail, without prejudice to the provisions of article 12 and without prior formal notice :

The forfeiture of the term of all sums due by the deliverer and their immediate payment;

In addition to the acceleration of the term, the party intervening with the YASSIR EXPRESS platform may be exposed to increases;

 (ii) the immediate suspension of the Services in progress until the payment of the totality of the sums owed by the participant to the YASSIR EXPRESS platform;

 7- Data

The participant in the YASSIR EXPRESS platform expressly acknowledges and accepts :

That the data collected on the Yassir EXPRESS DELIVERY application and/or website and on the computer equipment of YASSIR EXPRESS are proof of the reality of the operations carried out within the framework of the present contract;

That these data constitute the only mode of proof accepted between the parties, in particular for the calculation of the sums due to YASSIR.

The party involved with the YASSIR EXPRESS platform may access this data in its personal account.

8- Obligation of the parties:

8.1. Obligation of the company: 

– To offer the delivery person a free download of the Yassir EXPRESS application;

– To provide the delivery person with a presentation page on the Yassir EXPRESS DELIVERY application based on the information provided by him.

-To make available to the participant in the YASSIR EXPRESS platform and or the Yassir EXPRESS DELIVERY application a service for managing his account, in particular the history of his orders;

– To offer to the participant in the YASSIR EXPRESS platform an evaluation and rating service in order to improve the quality of the service.

– To provide the YASSIR EXPRESS consultant with a T-shirt and/or a Kway bearing the name and logo of Yassir EXPRESS.

– Define deadlines and organize appointments for the payment of the commission of Yassir Express; 

8.2. Obligation of the intervening party to the YASSIR EXPRESS platform: 

  Without prejudice to the other obligations provided for herein, the participant in the YASSIR EXPRESS platform undertakes to :

To place his two-wheeled vehicle at the disposal of the company at the moment when the E-consumer places an order, until its delivery; 

Once the E-consumer’s order is accepted by the intervening party at the YASSIR EXPRESS platform, the latter shall collect it from the designated service provider in order to recover the order; 

To check the content of the order so that it corresponds to the request of the E-consumer;

 Ensure that the order is properly packaged; 

Load the order into the insulated container for transportation; 

Respect the laws and regulations in force and not infringe the rights of third parties or public order;

Update his information on his personal account in case of modifications, so that they always correspond to the above-mentioned criteria (Name, first name, telephone number, etc.);

To use the service personally and not to allow any third party to use it in his place or on his behalf; 

Be careful and discerning in its relations and communications;

To respect the usual rules of politeness and courtesy, in his exchanges with the other users of the services of Yassir (E-supplier and E-consumer);

To enjoy all his civil rights;

Respect the traffic rules; 

Wear a safety helmet during his deliveries; 

Wear a T-shirt and/or a Kway bearing the name and the logo of Yassir EXPRESS, so that he is easily recognized as a participant in the YASSIR EXPRESS platform by both the E-provider and the E-consumer; 

To respect the prices displayed on the Yassir EXPRESS delivery application;

To respect the deadline of the order of each eligible country ;

To respect the program of availability established by Yassir EXPRESS;

To respect the terms of payment of the total amount of the order including the commission which rightfully belongs to YASSIR; 

To respect the procedures set up by Yassir EXPRESS in case of verbal and/or physical aggression by the E-consumer;

To provide the company with all the information necessary for the proper execution of the service, cooperating actively with it for the proper execution of the present;

9- Responsibility of the parties

9.1. Responsibility of the company

  • The Company shall in no case be liable for the relations between the E-consumers and the parties involved with the YASSIR EXPRESS platform; 
  • The Company undertakes to carry out regular checks to verify the proper functioning and accessibility of the application. In this respect, it reserves the right to temporarily interrupt access to the application for maintenance reasons; 
  • Similarly, it cannot be held responsible for difficulties or temporary impossibility of access to the application due to circumstances beyond its control, force majeure, or due to disruptions in telecommunications networks;
  • The company cannot be held responsible for contents whose authors are third parties, any possible complaint must be directed in the first place towards the author of the contents in question, the contents prejudicial to a third party can be the subject of a notification to the company which reserves to take the measures described in article 12 of the present;
  • The company declines all responsibility in case of possible loss of the information accessible in the personal account of the participant in the YASSIR EXPRESS platform when this loss has been caused by the fact of the participant in the YASSIR EXPRESS platform;
  • The company disclaims all responsibility in case of use of the service not in conformity with the present conditions by the participant in the YASSIR EXPRESS platform, and declines all responsibility in case of a possible prejudice that could result from the unavailability of the Yassir EXPRESS applications or from a connection problem.   

9.2 Responsibility of the party involved with the YASSIR EXPRESS platform:

  • The party involved with the YASSIR EXPRESS platform acknowledges having taken cognizance of all the clauses of the present general terms and conditions of use of YASSIR EXPRESS DELIVERY, in particular with regard to delays, errors in the orders without verifying them, or failure to notify the company in the event of an incident; in this respect, the company shall take any measure against the party involved with the YASSIR EXPRESS platform, in particular the reimbursement of the orders that have not been forwarded as a result of an error committed by the party involved with the YASSIR EXPRESS platform; 
  • The participant onthe YASSIR EXPRESS platform guarantees that all the information he communicates in the registration form is exact, up to date and sincere and is not vitiated by any misleading character;
  • He is informed and accepts that the information entered for the purpose of creating or updating his profile is proof of his identity; 
  • He is informed and accepts that the implementation of the service requires that he is connected to the Internet and that the quality of the service depends directly on this connection, for which he is solely responsible; 
  • He is also solely responsible for the relationships he may establish with other users and the information he communicates to them within the framework of the said service;
  • He/she is solely responsible for the content of any kind (editorial, graphic, audiovisual or other, including the name and/or image that may be chosen to identify him/her on the application) that he/she disseminates within the framework of the service (hereinafter referred to as “Content”); 
  • He guarantees the company that he has all the rights and authorizations necessary for the distribution of these contents;
  • The User agrees that said content is legal and does not infringe on public order, good morals or the rights of third parties.

10- Special conditions : 

10.1. In case of delay or incident:

In accordance with the rules of usage, the party intervening onthe YASSIR EXPRESS platform is informed that in case of delay or incident suffered during the delivery service, of the obligation to contact the E-consumer by telephone to warn him, he also undertakes to inform the company as soon as possible, in order to take any necessary measure. 

10.2 In case of an incident during the service

– In the event of an incident (traffic accident, theft, damage to the two-wheeled vehicle, aggression on the part of the person working on the YASSIR EXPRESS platform, etc.) during the performance of the service, the person working on the YASSIR EXPRESS platform shall be invited (insofar as possible) to notify the company as soon as possible and to transmit to it all useful information, via all the communication media referred to in Article 02 as well as any other medium made available to him/her; 

– In the event of aggression and/or degradation by the E-consumer, the company shall take all necessary measures against the offending E-consumer (exclusion from the Application, definitive deletion of his or her Profile); 

11- Prohibited behaviour

By accepting the present general conditions of use of the Yassir EXPRESS application, the user of the YASSIR EXPRESS platform acknowledges having taken cognizance of the following

That it is strictly forbidden to undermine public order or to violate the laws and regulations in force; 

That it is strictly forbidden to arrive late without a valid reason; 

It is strictly forbidden to present oneself to the service provider and/or the E-consumer without the T-shirt bearing the (name, logo) Yassir EXPRESS; 

That it is strictly forbidden to have altercations with the E-consumer and / or service provider;

That it is strictly forbidden to insult the E-consumer and / or service provider;

That it is strictly forbidden to negotiate the prices displayed in advance on the Yassir EXPRESS application; 

That it is strictly forbidden to cancel the delivery after having accepted it; 

It is strictly forbidden to commit acts of violence;

It is strictly forbidden to drive under the influence of drugs or alcohol; 

It is strictly forbidden to sexually harass E-consumers;

It is strictly forbidden to contact E-consumers outside the Yassir EXPRESS DELIVERY application; 

The contributor to the YASSIR EXPRESS platform, who does not respect these instructions, will be subject to sanctions, depending on the seriousness of his act, ranging from a simple verbal warning, to the definitive deletion of his account as well as the termination of his partnership contract without notice.

12- Sanctions for Breaches 

In the event of failure to comply with one of the provisions of the present general conditions or more generally, of infringement of the laws and regulations in force by the participant in the YASSIR EXPRESS platform, the company reserves the right to take any appropriate measure, in particular that of :

– To suspend or terminate the access to the service of the participant to the YASSIR EXPRESS platform, the author of the breach or infringement, or of the prohibited behavior, having participated in it;

– To terminate the contract established between the participant in the YASSIR EXPRESS platform and the company without prior notice;

– Delete any content put online on the application;

– To warn any concerned authority;

– To engage any legal action;

13- Intellectual property

The systems, software, structures, infrastructures, databases and contents of any kind (texts, images, visuals, music, logos, brands, databases, etc.) exploited by YASSIR within the YASSIR EXPRESS DELIVERY application and/or website are protected by all intellectual property rights or rights of the producers of databases in force. All disassemblies, decompilations, decryptions, extractions, reuses, copies and more generally, all acts of reproduction, representation, diffusion and use of any of these elements, in whole or in part, without the authorization of YASSIR are strictly prohibited and may be subject to legal proceedings.

14- Personal data

YASSIR practices a policy of personal data protection, the characteristics of which are explained in the document entitled “Privacy Policyr”, and of which the user of the YASSIR EXPRESS platform is expressly invited to take cognizance on the application and/or the website.

15- Advertising

In order to improve the service of Yassir EXPRESS and to increase the number of E-consumers, the participant in the YASSIR EXPRESS partner platform agrees to authorize the company to hang a sticker bearing the logo and the name of the service and/or to hang a sign on his two-wheeled vehicle made available, the aim being to inform, promote, indicate, communicate and improve the service, provided, of course, that this does not cause any damage or alteration to his two-wheeled vehicle. 

16- Links and third party sites

YASSIR shall in no case be held responsible for the technical availability of internet sites or mobile applications operated by third parties (including its possible partners) to which the user of the YASSIR EXPRESS platform would have access via the site.

YASSIR does not assume any responsibility for the contents, advertisements, products and/or services available on such third party sites and mobile applications, which are governed by their own conditions of use.

YASSIR is not responsible either for the transactions between the user of the YASSIR EXPRESS platform and any advertiser, professional or trader (including its possible partners) to whom the user of the YASSIR EXPRESS platform would be directed via the site and shall in no case be a stakeholder in possible disputes with these third parties concerning in particular the delivery of products and/or services, the guarantees, the declarations and other obligations to which these third parties are bound.

17- Duration of the Services, unsubscription

The Services are subscribed for an indefinite period.

The user of the YASSIR EXPRESS platform may unsubscribe from the Services at any time, by sending a request to this effect to YASSIR by email, to the contact details mentioned in article 2.

The unsubscription is effective immediately. It shall entail the automatic deletion of the account of the Participant with the YASSIR EXPRESS platform. 

18- Modifications

YASSIR reserves the right to modify at any time the present general conditions.

The participant in the YASSIR EXPRESS platform shall be informed of these modifications by any useful means.

 The user of the YASSIR EXPRESS platform who does not accept the modified general terms and conditions must unsubscribe from the Services in accordance with the terms and conditions set forth in Article 17.

Any User who makes use of the Services after the entry into force of the modified general terms and conditions shall be deemed to have accepted these modifications.

19- Applicable law and jurisdiction

These terms and conditions are governed by the laws of each country eligible for these terms and conditions.

In the event of a dispute concerning the validity, interpretation and/or execution of these general terms and conditions, the parties of each eligible country mentioned in article 02 of these terms and conditions agree to bring the dispute to the competent court.

20- Entry into force

The present general terms and conditions shall come into force as soon as the participant to the YASSIR EXPRESS platform accepts them by pressing the “accept” field.
